By creating an account or using TideMerge ("Service"), you agree to these Terms of Service ("Terms") between you ("Customer," "you") and TideMerge ("TideMerge," "we," "us"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

TideMerge provides an AI-powered phone receptionist platform ("Frontline AI") that answers inbound calls, books appointments, qualifies leads, and sends automated follow-up messages on behalf of your business. The Service includes:

TideMerge charges subscription fees as described on our pricing page. By subscribing, you authorize us to charge your payment method on a recurring basis.
To cancel your subscription, contact us at hello@tidemerge.com before your next billing date. Cancellations take effect at the end of your current billing period.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:
TideMerge and its licensors own all rights to the Service, including software, AI models, designs, and documentation. These Terms do not grant you any ownership rights in the Service.
You retain ownership of all content and data you provide to us (your business information, voice recordings you submit, call scripts). By providing this content, you grant TideMerge a limited license to use it solely to provide the Service to you.
We aim for high uptime but do not guarantee uninterrupted service. The Service is provided "as is" and "as available." We may perform maintenance that temporarily affects availability, and we will provide advance notice where practical.
TideMerge is not liable for any losses resulting from Service downtime, call failures, or integration errors beyond our reasonable control.
To the maximum extent permitted by law, TideMerge's total liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid us in the 3 months immediately preceding the claim.
In no event shall TideMerge be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities, even if we have been advised of the possibility of such damages.
Either party may terminate these Terms at any time. You may cancel your account by contacting us. We may suspend or terminate your account if you violate these Terms, with or without notice depending on severity.
Upon termination, your access to the Service ends. We will delete your data within 30 days of account closure, except where retention is legally required.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Diego County, California, and both parties consent to personal jurisdiction there.
Before filing any legal claim, you agree to contact us at hello@tidemerge.com and give us 30 days to attempt to resolve the dispute informally.
We may update these Terms as our Service evolves. For material changes, we will notify you by email at least 14 days before they take effect. Your continued use of the Service after that date constitutes your acceptance of the updated Terms.
